Information clause for the contractor or contractor's representative of ZPC SKAWA S.A.

Information about the processing of personal data in Zakłady Przemysłu Cukierniczego "SKAWA" S.A. (hereinafter: ZPC "SKAWA" SA, the Company)

Pursuant to Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO), we inform you that:

  3. We process your personal data for the following purposes:
  • to fulfill contractual obligations to you, if you are or will be a party to a contract with the Company, or to take certain actions prior to entering into a contract, such as preparing a draft contract (Article 6(1)(b) of the DPA);
  • to fulfill the Company's legal obligations (Article 6(1)(c) of the DPA) - with regard to personal data contained in documents subject to archiving under the law;
  • realization of the Company's legitimate interests (Article 6(1)(f) RODO). Such legitimate interests are:
  • To enable us to contact Contractors and to handle a given contract;
  • retention of records for the purpose of demonstrating compliance with legal obligations;
  • Prevention of fraud and criminal activity;
  • Establishing or asserting civil law claims in the course of business, as well as defending against such claims;
  • verification of Contractors in public records.
  1. Recipients of your personal data may be:
  • Financial institutions involved in the implementation and settlement of the contract;
  • courier or postal service providers;
  • entities providing services in the field of supply and maintenance or hosting of IT systems or tools for processing personal data,
  • Authorities authorized to process such data under the law
  1. Your data will not be transferred to third countries within the meaning of the General Data Protection Regulation.
  2. Storage periods for personal data at ZPC SKAWA SA
  • If the basis for data processing is the performance of a contract, then the data will be processed for as long as necessary for the performance of the contract, and thereafter for a period of time corresponding to the statute of limitations for claims that the Company may raise and that may be raised against the Company.
  • If the basis for the processing of personal data is the Company's legitimate interests, the personal data will be kept for the period necessary for the Company's legitimate interests.
  • If the basis for the processing of personal data is consent, then personal data may be processed for as long as the consent is not revoked. Once consent is revoked, for a period of time corresponding to the statute of limitations for claims that the Company may raise and that may be raised against the Company.
  • If there are legal regulations specifying the length of time for which personal data should be stored, then ZPC "SKAWA" SA will apply the law to the storage of data.
  1. You have the right to access and rectify the content of your data and:
  • The right to erasure, restriction of processing, the right to object to processing, and the right to data portability - subject to laws and regulations restricting these rights;
  • The right to withdraw consent, at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal, when processing is carried out on the basis of consent;
  • The right to lodge a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection, about the processing of personal data in violation of the provisions of the RODO.
  1. Provision of personal data is voluntary but is a condition for undertaking the purposes for which they are collected.
  2. ZPC "SKAWA" SA does not make any decisions that are based on automated processing, including profiling
